In 2002, in response to the 9/11 attacks and concerns over terrorist threats to our food supply, Congress passed the Public Health Security and Bioterrorism Preparedness and Response Act of 2002, more commonly known as The Bioterrorism Act.

Food processors with between 11-499 full-time employees had until June 9, 2006 to comply (less than 10 full-time employees had until December 11, 2006). According to the ruling, upon an FDA request, you have 24 hours to produce the following information or be subject to civil and/or criminal penalties:

  1. Identify the immediate non-transporter previous sources, whether foreign or domestic, of all foods received, including lot or code number or other identifier
  2. .
  3. Identify the immediate non-transporter subsequent recipients of all foods released, including lot or code number or other identifier
  4. Identify the specific source of each ingredient that was used to make every lot of finished product
  5. .

Regrettably in this modern uncertain world we live in, the probability of a bioterrorist attack is not inconceivable and indeed is probable.

Do you have some form of automated system to track supplier and lot numbers of all of the ingredients going into every finished product you make? If not, it will be extremely difficult to comply with the FDA ruling in the event a request for the data is made.
